Types of Criminal Cases Handled by a Defense Expert

A criminal defense expert is equipped to handle a wide range of criminal cases. These cases may include drug offenses, such as possession, trafficking, or manufacturing of illegal drugs. They may also represent individuals accused of assault, theft, burglary, or domestic violence.

In addition, a criminal defense expert is experienced in defending clients involved in financial crimes, such as fraud, embezzlement, or money laundering. They can also handle cases related to cybercrimes, organized crime, and white-collar offenses.

No matter the nature or severity of the charges, a criminal defense expert is dedicated to offering skilled representation to their clients and protecting their rights throughout the legal process.

Key Steps in Building a Criminal Defense Strategy

Building a strong defense strategy requires a comprehensive approach that involves several key steps. First, the criminal defense expert will conduct a thorough investigation into the facts and circumstances surrounding the alleged offense. This may involve interviewing witnesses, reviewing surveillance footage, or consulting forensic experts.

After gathering all the relevant information, the attorney will carefully analyze the evidence and any applicable laws to identify potential defense strategies. This may include challenging the legality of the search and seizure, questioning the reliability of witness testimonies, or presenting an alibi or self-defense argument.

Once the defense strategy is established, the attorney will develop a cohesive plan and gather evidence to support it. This may involve obtaining expert opinions, gathering character references, or conducting further investigations. The defense team will also anticipate the prosecution’s arguments and prepare to counter them effectively.

Throughout the process, the criminal defense expert will maintain open communication with their clients, keeping them informed about the progress of the case and seeking their input. This collaborative approach ensures that the defense strategy aligns with the clients’ goals and priorities.

Common Misconceptions about Criminal Defense

There are several common misconceptions about criminal defense that it is important to address. One misconception is that only guilty individuals need a defense attorney. In reality, the right to legal representation applies to all individuals who are facing criminal charges, regardless of their guilt or innocence. A criminal defense expert ensures that everyone, regardless of their circumstances, receives a fair trial and has their rights protected.

Another misconception is that a defense attorney’s primary goal is to help their client avoid all consequences. While minimizing the charges or penalties is certainly a goal, a defense attorney’s overarching duty is to ensure that their client’s constitutional rights are upheld and that they receive a fair trial.

Preparing an expert witness

Effective preparation is crucial for an expert witness to provide persuasive and credible testimony. Attorneys should take the following steps to prepare an expert witness:

  1. Provide case materials: Furnish the expert witness with all relevant case materials, including pleadings, reports, depositions, and expert reports from opposing experts. Give them ample time to review and analyze the materials thoroughly.

  2. Discuss the case strategy: Engage in detailed discussions with the expert witness about the theory of the case, the key elements they need to address, and the specific issues they should focus on in their testimony. Ensure that the expert witness understands the overall strategy and goals of the case.

  3. Prepare the expert report: Work closely with the expert witness to draft a comprehensive report that summarizes their findings, opinions, and the methodology used. Review the report together, making sure it accurately represents the expert’s opinions and follows all applicable rules and guidelines.

  4. Conduct mock examinations: Arrange mock examinations or trial simulations to help familiarize the expert witness with the courtroom environment and prepare them for cross-examination. These practice sessions can improve their confidence, presence, and ability to effectively communicate their opinions.

  5. Research opposing arguments: Anticipate the arguments that opposing counsel may present during cross-examination and equip the expert witness with the knowledge and resources necessary to counter those arguments effectively. Arm them with detailed responses and additional evidence to support their opinions.

By dedicating time and effort to prepare an expert witness adequately, attorneys can ensure that they are well-prepared to provide compelling testimony that strengthens their case.

Challenges faced by expert witnesses

While expert witnesses play a vital role in the legal process, they often face various challenges that can impact their effectiveness. Some common challenges faced by expert witnesses include:

  1. Cross-examination tactics: Opposing counsel may employ aggressive tactics during cross-examination to challenge the credibility of the expert witness and discredit their opinions. It is crucial for expert witnesses to remain calm, composed, and confident while articulating their arguments and opinions.

  2. Conflicting expert opinions: In some cases, there may be multiple expert witnesses offering differing opinions on the same matter. This can create confusion, and the expert witness must be prepared to justify their position and provide clear and persuasive explanations for any inconsistencies.

  3. Limited time for preparation: Expert witnesses are often retained late in the legal process, giving them limited time to review and analyze complex materials. This time constraint can impact their ability to provide comprehensive opinions and may increase the risk of errors or oversights.

  4. Complex legal procedures: Expert witnesses who are not regularly exposed to legal proceedings may find the complexities of the legal system overwhelming. Understanding court protocols, rules of evidence, and the expectations of the judge or jury can be challenging and may require additional guidance from the retaining attorney.

To overcome these challenges, expert witnesses should work closely with the retaining attorney, update themselves on recent developments in their field, continuously improve their communication skills, and seek professional training and support when necessary.

Expert Witness

Cross-examination of an expert witness

Cross-examination is a critical phase in a trial where opposing counsel has the opportunity to challenge the credibility and opinions of an expert witness. During cross-examination, the following strategies are commonly employed:

  1. Challenging the expert’s qualifications: Opposing counsel may attempt to question the expert witness’s qualifications, credentials, or expertise to challenge their right to provide an opinion. The expert witness must be prepared to defend their qualifications and establish their credibility.

  2. Highlighting inconsistencies: Opposing counsel may search for inconsistencies within the expert witness’s testimony or reports to undermine their overall credibility. It is essential for the expert witness to maintain consistency and credibility throughout their testimony.

  3. Attacking the methodology: Opposing counsel may attempt to discredit the expert witness’s methodology or criticize their choice of approach. The expert witness should be prepared to explain and defend their methodology, demonstrating its reliability and relevance to the case.

  4. Questioning bias: Opposing counsel may question the expert witness’s impartiality or suggest a potential bias that could influence their testimony. The expert witness must emphasize their objectivity and their adherence to professional ethics and standards.

Expert witnesses should be thoroughly prepared for cross-examination by conducting mock examinations and being familiar with the potential tactics opposing counsel may employ. By remaining composed, confident, and knowledgeable, expert witnesses can effectively navigate the challenges posed during cross-examination.

This means that the value of the business must be reported at its full value, without any discounts. However, if the business is being transferred to a family member, the IRS allows for the use of valuation discounts. These discounts can be used to reduce the taxable value of the business, resulting in a lower tax liability.

Valuation discounts are typically based on the size of the business, the type of business, and the relationship between the buyer and seller. For example, a family-owned business may be eligible for a discount due to the close relationship between the buyer and seller. Similarly, a small business may be eligible for a discount due to its size.

When using valuation discounts, it is important to understand the tax implications. The IRS requires that the discounted value of the business be reported as the fair market value. This means that the discounted value must be reported as the full value of the business, without any discounts. Additionally, the IRS requires that the discounted value be reported on the tax return of the seller. This means that the seller must pay taxes on the discounted value of the business, even though they may have received less money for the sale.

In addition to the tax implications, it is important to understand the legal implications of using valuation discounts.

Valuation discounts can be a useful tool for reducing taxes when transferring ownership of a business. However, it is important to understand the tax and legal implications of using them. By understanding the implications of using valuation discounts, businesses can ensure that they are taking advantage of all available tax savings opportunities.

The Pros and Cons of Utilizing Valuation Discounts On The Transfer Of a Business

Valuation discounts are a common tool used to reduce the value of a business when transferring ownership. These discounts are typically used to account for the lack of control and marketability of the business. While valuation discounts can be beneficial in certain situations, they can also have drawbacks that should be considered before utilizing them.

Pros

The primary benefit of utilizing valuation discounts is that they can significantly reduce the value of a business when transferring ownership. This can be beneficial for both the buyer and seller, as it can make the transaction more affordable for the buyer and increase the seller’s return on investment. Additionally, valuation discounts can be used to reduce the amount of taxes owed on the sale of the business.

Cons

The primary drawback of utilizing valuation discounts is that they can be difficult to justify to the IRS. The IRS may challenge the use of valuation discounts if they believe that the discounts are not reasonable or necessary. Additionally, valuation discounts can reduce the amount of money that the seller receives from the sale of the business, which can be a significant disadvantage.

In conclusion, valuation discounts can be a useful tool for reducing the value of a business when transferring ownership. However, it is important to consider the potential drawbacks before utilizing them, as they can be difficult to justify to the IRS and can reduce the amount of money that the seller receives from the sale.

How to Calculate Valuation Discounts On The Transfer Of a Business

Valuation discounts are an important consideration when transferring a business. These discounts can significantly reduce the value of a business, so it is important to understand how they are calculated.

Valuation discounts are typically applied to the value of a business when the business is transferred to a new owner. These discounts are based on the fact that the new owner will not have the same control over the business as the original owner. This lack of control can reduce the value of the business, and the discount is intended to reflect this.

The most common type of valuation discount is the minority discount. This discount is applied when the new owner will not have a controlling interest in the business. The size of the discount is based on the percentage of ownership the new owner will have. The larger the minority interest, the larger the discount.

Another type of valuation discount is the marketability discount. This discount is applied when the new owner will not be able to easily sell their interest in the business. This could be due to restrictions on the transfer of ownership, or because the business is not publicly traded. The size of the discount is based on the difficulty of selling the interest.

Finally, the control premium discount is applied when the new owner will not have the same level of control over the business as the original owner. This discount is based on the fact that the new owner will not be able to make decisions about the business in the same way as the original owner.

When calculating valuation discounts, it is important to consider all of the factors that could affect the value of the business. This includes the size of the minority interest, the difficulty of selling the interest, and the level of control the new owner will have. By taking all of these factors into account, it is possible to accurately calculate the valuation discounts that should be applied to the transfer of a business.

How to Prepare for a Business Succession

Business succession planning is an important part of any business owner’s long-term strategy. It is essential to ensure that the business will continue to thrive and grow even after the current owner has retired or passed away. Here are some tips to help you prepare for a successful business succession:

1. Establish a succession plan: A succession plan should be established early on in the business’s life cycle. This plan should include the roles and responsibilities of the current owner, the successor, and any other stakeholders. It should also outline the timeline for the transition and the steps that need to be taken to ensure a smooth transition.

2. Choose the right successor: Choosing the right successor is essential for a successful business succession. The successor should have the necessary skills and experience to lead the business into the future. It is also important to consider the successor’s commitment to the business and their ability to work with the current owner.

3. Develop a transition plan: A transition plan should be developed to ensure that the business is prepared for the transition. This plan should include the steps that need to be taken to transfer ownership, such as transferring assets, updating legal documents, and transferring knowledge.

4. Update legal documents: It is important to update all legal documents, such as contracts, leases, and other agreements, to ensure that they are up-to-date and reflect the new ownership structure.

5. Train the successor: The successor should be trained in all aspects of the business, including operations, finance, and marketing. This will ensure that they are prepared to take over the business and lead it into the future.

6. Communicate with stakeholders: It is important to communicate with all stakeholders, such as employees, customers, suppliers, and investors, to ensure that they are aware of the transition and understand the new ownership structure.

By following these tips, you can ensure that your business succession is successful and that the business will continue to thrive and grow in the future.

Understanding the Processes of Business Succession

Business succession is the process of transferring ownership and management of a business from one generation to the next. It is an important process for any business, as it ensures the continuity of the business and its operations.

Succession planning is the process of preparing for the transfer of ownership and management of a business. It involves identifying and developing potential successors, assessing the business’s financial and legal needs, and creating a plan for the transition.

The first step in succession planning is to identify potential successors. This includes assessing the skills and experience of current employees, as well as identifying potential external candidates. It is important to consider the long-term goals of the business and the skills and experience needed to achieve those goals.

The next step is to assess the financial and legal needs of the business. This includes evaluating the current financial situation of the business, assessing the tax implications of the transition, and determining the legal requirements for the transfer of ownership.

Once the potential successors and the financial and legal needs of the business have been identified, a plan for the transition can be created. This plan should include a timeline for the transition, a plan for training and developing the successors, and a plan for the transfer of ownership.

Finally, the transition should be monitored and evaluated. This includes assessing the progress of the transition, ensuring that the successors are adequately trained and developed, and evaluating the financial and legal implications of the transition.

Business succession is an important process for any business. It ensures the continuity of the business and its operations, and helps to ensure that the business is well-positioned for future success. By following the steps outlined above, businesses can ensure that their succession planning process is successful.

What Are the Different Types of Business Succession Strategies?

Business succession strategies are important for any business owner to consider, as they provide a plan for the future of the business. There are several different types of business succession strategies, each with its own advantages and disadvantages.

The first type of business succession strategy is an internal succession plan. This type of plan involves the current owner of the business transferring ownership to a family member or trusted employee. This type of plan is beneficial because it allows the current owner to maintain control over the business and ensure that it is passed on to someone who is familiar with the business and its operations.

The second type of business succession strategy is an external succession plan. This type of plan involves the current owner of the business transferring ownership to an outside party, such as an investor or a business partner. This type of plan is beneficial because it allows the current owner to receive a financial return on their investment and also allows them to maintain some control over the business.

The third type of business succession strategy is a buy-sell agreement. This type of plan involves the current owner of the business transferring ownership to a third party, such as a business partner or investor, in exchange for a predetermined amount of money. This type of plan is beneficial because it allows the current owner to receive a financial return on their investment and also allows them to maintain some control over the business.

The fourth type of business succession strategy is a merger or acquisition. This type of plan involves the current owner of the business transferring ownership to another business in exchange for a predetermined amount of money. This type of plan is beneficial because it allows the current owner to receive a financial return on their investment and also allows them to maintain some control over the business.

Finally, the fifth type of business succession strategy is a liquidation. This type of plan involves the current owner of the business transferring ownership to a third party, such as a liquidator, in exchange for a predetermined amount of money. This type of plan is beneficial because it allows the current owner to receive a financial return on their investment and also allows them to maintain some control over the business.

Each of these business succession strategies has its own advantages and disadvantages, and it is important for business owners to consider all of their options before making a decision. It is also important to consult with a qualified professional to ensure that the chosen strategy is the best option for the business.

Business Contract Attorney

A lawyer for business contracts helps companies and entrepreneurs manage the contracts that serve as the backbone of their business. Business contracts lawyers are critical to making sure their clients stay protected and are not put into any relationships that may cause unnecessary risk for the business. Business lawyers may help with contract drafting, negotiations, and contract review services. If you’re a business owner and you haven’t had to deal with a legal contract yet, the day will come when you must do so, and you’ll want a business contract lawyer on your side when it does.

A contract is a legally enforceable agreement between or among two or more parties that mutually ratifies certain rights and promised obligations. (A binding agreement between actors in international law is known as a treaty.) A contract typically involves the transfer of goods, services, money, or a promise to transfer any of those at a future date. In the event of a breach of contract, the injured party may seek judicial remedies such as damages or rescission. Contract law, the field of the law of obligations concerned with contracts, is based on the principle that agreements must be honored. Contract law, like other areas of private law, varies between jurisdictions. The various systems of contract law can broadly be split between common law jurisdictions, civil law jurisdictions, and mixed law jurisdictions which combine elements of both common and civil law. Common law jurisdictions typically require contracts to include consideration in order to be valid, whereas civil and most mixed law jurisdictions solely require a meeting of the minds between the parties.

Within the overarching category of civil law jurisdictions, there are several distinct varieties of contract law with their own distinct criteria: the German tradition is characterized by the unique doctrine of abstraction, systems based on the Napoleonic Code are characterized by their systematic distinction between different types of contracts, and Roman-Dutch law is largely based on the writings of renaissance-era Dutch jurists and case law applying general principles of Roman law prior to the Netherlands’ adoption of the Napoleonic Code. The UNIDROIT Principles of International Commercial Contracts, published in 2016, aim to provide a general harmonized framework for international contracts, independent of the divergences between national laws, as well as a statement of common contractual principles for arbitrators and judges to apply where national laws are lacking. Notably, the Principles reject the doctrine of consideration, arguing that elimination of the doctrine “brings about greater certainty and reduce litigation” in international trade. The Principles also rejected the abstraction principle on the grounds that it and similar doctrines are “not easily compatible with modern business perceptions and practice”.

Contract law can be contrasted with tort law (also referred to in some jurisdictions as the law of delicts), the other major area of the law of obligations. While tort law generally deals with private duties and obligations that exist by operation of law, and provide remedies for civil wrongs committed between individuals not in a pre-existing legal relationship, contract law provides for the creation and enforcement of duties and obligations through a prior agreement between parties. The emergence of quasi-contracts, quasi-torts, and quasi-delicts renders the boundary between tort and contract law somewhat uncertain.

Common Types of Business Contracts

Lawyers for business contracts are professionals that you want to have on your side if you’re an entrepreneur. Not only do they make the process of creating contracts and reviewing them easier, but they offer unparalleled peace of mind when it comes to making business agreements. Business contract lawyers specialize in many different contract areas. Here are some common types of contracts that you can count on a business contract lawyer to help with:

Service Contracts

Service contracts cover agreements between a buyer and a seller. Whether you’re completing equipment leases needed to complete a job or you need help with a contract to send to customers, lawyers for business contracts can help.

Investment Contracts

Investment contracts govern the agreements between you and the people that give you money to run your business. These relationships are essential to the success of your business, so you need to be sure that the contract is mutually beneficial. A business contract lawyer can help you create, audit, and even modify existing terms of a contract for the best outcome for all involved parties.

Partnership Agreements

Business partnership agreements are the perfect way to enter business with a fellow entrepreneur. However, things can get messy if the roles and responsibilities of each member of the partnership are not set out ahead of time. Taking advantage of the help of a business contract lawyer can help your business run more smoothly by making sure all this information is clearly stated in the contract. Lawyers for business contracts can also help with these agreements:

LLC agreements

S Corp agreements

C Corp agreements

Commercial Lease Agreements

If you need office space, you’re going to need to enter into a commercial lease agreement . Sounds simple, right? Unfortunately, the terms of a commercial lease agreement are wildly different than the rules you may be familiar with from residential versions.

It Is strongly recommended that you employ the assistance of a business contract lawyer to help you with commercial lease agreements. The terms involved can get complicated and can end up turning out badly for you without the right guidance.

Confidentiality Agreement Contracts

Confidentiality agreements are crucial to many business operations, especially when dealing with proprietary information. Business lawyers make sure all the bases are covered on these agreements, so you don’t have to worry about your trade secrets getting out.

Employment Contracts

When you bring new employees on board with your company, it’s always a good idea to be sure the right expectations are set from the beginning. Creating an employment contract is a great way to set expectations and create terms and conditions surrounding employment.

What Types of Lawyers Look Over Business Contracts?

Even though all lawyers are well-versed in certain areas of law, not every specialty is suitable for business contract dealings. When you’re dealing with business agreements, you must hire the right lawyer to get the job done correctly.

Here is an overview of the types of lawyers that can help look over business contracts:

Real estate lawyers

General business lawyers

Employment lawyers

Tax lawyers

Intellectual property lawyers

Securities lawyers

Hiring a business contract lawyer can help you discern which contracts are the most beneficial for your industry and line of work.

How Much do Business Contract Lawyers Cost?

Even though hiring a business contract lawyer can be a hefty investment depending on what you need, it’s well worth the money. This is true especially if you ever find yourself in legal disputes since business contracts enforce many of the things that protect your business from being negatively impacted.

Typically, the cost for a business lawyer can range anywhere from $350 to $925 an hour and some attorneys require a retainer upfront to secure the relationship. Don’t let the cost deter you – paying now can save you money later.

Remember that successful business contracts foster positive relationships with business partners, employees, and customers. Instead of focusing on the financial investment it takes to work with a contract lawyer, think about the benefits it will bring to your business relationships.

Common Fee Structures for Business Contract Lawyers

When you work with a business contract lawyer, you can expect a fee structure to be in effect. This allows lawyers to work with entrepreneurs in a way that makes sense for all parties involved.

Here Is a quick overview of how business contract lawyer fees are structured:

Hourly Rate

Many business contract lawyers operate on an hourly rate basis. This usually involves an hourly rate that is billed for all activities that include communicating with the lawyer. You can expect to be billed hourly for time spent doing the following:

Contract drafting

Contract review

Contract editing

Breach of contract

Other business services

Some business lawyers charge flat fees for their services. This type of fee structure involves a pre-agreed-upon amount of money to be exchanged for business contract services. When you agree to work with a lawyer on a flat-fee basis, it doesn’t matter how many hours are spent, you only pay one set price.
This is beneficial for those who need extensive contract work done. However, if you’re interested in working with a business contract lawyer for basic contract services, you may consider working with a lawyer on an hourly rate basis to save money.

Contingency Fees

Contingency fees are charged at the end of a legal battle. If you’re expecting a battle to result in a settlement, a lawyer set up on a contingency fee basis takes a percentage of the settlement to cover their services.

Statutory Fees

The Impact of Recent Changes in Business Law on Businesses

Recent changes in business law have had a significant impact on businesses. These changes have been implemented to ensure that businesses are operating in a fair and ethical manner, and to protect the rights of consumers.

One of the most significant changes in business law is the introduction of the General Data Protection Regulation (GDPR). This regulation was introduced in 2018 and applies to all businesses that process personal data of EU citizens. It requires businesses to be transparent about how they use personal data, and to ensure that it is stored securely. Businesses must also obtain consent from individuals before collecting and using their data. Failure to comply with the GDPR can result in hefty fines.

Another important change in business law is the introduction of the Consumer Rights Act 2015. This act provides consumers with a range of rights, including the right to receive accurate information about products and services, the right to receive goods that are of satisfactory quality, and the right to receive a refund if goods are not fit for purpose. Businesses must ensure that they are compliant with the Consumer Rights Act, or they could face legal action.

Finally, the introduction of the Modern Slavery Act 2015 has had a significant impact on businesses. This act requires businesses to take steps to ensure that their supply chains are free from modern slavery and human trafficking. Businesses must conduct due diligence on their suppliers and take steps to ensure that they are not engaging in any form of exploitation.

Estate Planning in Utah County: What You Need to Know About the Process

Estate planning is an important process for anyone living in Utah County. It involves making decisions about how your assets will be managed and distributed after you pass away. Estate planning can help ensure that your wishes are carried out and that your loved ones are taken care of.

The first step in estate planning is to create a will. A will is a legal document that outlines how you want your assets to be distributed after you pass away. It can also include instructions for guardianship of minor children and other important decisions. It is important to make sure that your will is properly drafted and witnessed in order to ensure that it is legally binding.

The next step in estate planning is to create a trust. A trust is a legal entity that holds assets for the benefit of another person or entity. Trusts can be used to manage assets during your lifetime and after you pass away. They can also be used to provide for the care of minor children or other dependents.

The third step in estate planning is to create a power of attorney. A power of attorney is a legal document that allows you to appoint someone to manage your affairs if you become incapacitated. This person will be responsible for making decisions on your behalf, such as paying bills and managing investments.

Finally, it is important to review your estate plan periodically. This will ensure that your wishes are still being carried out and that your assets are being managed according to your wishes. It is also important to update your estate plan if your circumstances change, such as if you move to a different state or if you have a major life event, such as getting married or having a child.

Estate Planning in Provo: Getting a Health Care Directive

Estate planning is an important part of ensuring that your wishes are respected and your assets are protected. One important part of estate planning is creating a health care directive. A health care directive is a document that outlines your wishes for medical care in the event that you are unable to make decisions for yourself.

A health care directive is a legal document that is recognized in all 50 states. It is important to note that a health care directive is not the same as a living will. A living will is a document that outlines your wishes for end-of-life care, while a health care directive is a document that outlines your wishes for medical care in the event that you are unable to make decisions for yourself.

When creating a health care directive, it is important to consider the following:

• Who will make decisions for you if you are unable to make them for yourself?

• What types of medical treatments do you want or do not want?

• Do you want to be an anatomical donor for any purpose, including research, education, advancement, transplantation, therapy, or other purposes, but excluding any purpose that would be contrary to your religious beliefs?

Once you have considered these questions and made your decisions, it is important to have your health care directive properly drafted and signed by a notary public. It is also important to make sure that your health care directive is kept in a safe place and that your family and health care providers are aware of its existence.

Are Your Estate Planning Fees Tax Deductible?

In general, you can deduct legal fees as an ordinary and necessary business expense. The types of legal fees that are deductible include creation and review of contracts, filing a lawsuit or defending a lawsuit for breach of contract, legal assistance to collect on an account, defending an intellectual property right, defending against lawsuits brought by employees and receiving tax advice.

The amount of the bill that can be deducted in the case of tax advice for an estate plan varies. The more that tax play a role in estate planning process, the greater the percentage of the fee that can be deducted as a qualified expense. However, it is wise to always check with your tax professional before filing this deduction on your tax return. There are times in which legal fees are a necessary evil. When you are able to deduct your legal fees, they become less of an evil.

It’s important to understand, though, which legal fees are deductible and which are not. Personal legal fees (i.e.: fees used to pay a divorce attorney or fees used to hire an attorney to dispute a lawsuit that was brought against you) are non-deductible. These are considered personal expenses by the IRS, so that means you will not be able to claim them on your list of itemized deductions. If you own a corporation, an LLC, a partnership, or even if you are a sole proprietor, legal fees associated with helping the reputation of your business will be considered a business investment and will therefore be fully deductible. The term fully deductible means that there are no limitations or AMT (Alternative Minimum Tax) associated with your deduction.

In order to claim your investment legal fees, you must legitimately be conducting business. If you are not regularly filing as a proprietor, the legal fees associated with your business may be viewed by the IRS as miscellaneous itemized deductions. If this is the case, it will result in limitations being placed on your deductions. Legal fees which are equal to up to two per cent of your AGI (Adjusted Gross Income) are non-deductible. At higher income, deductions are completely phased out. Once you compute the AMT (which is a separate tax with a rate of 28 per cent), there is no deduction whatsoever. To avoid these limitations, you should file your US income tax as a proprietor and file Schedule C (assuming you are actually in business).

There is a different set of rules for attorneys with a contingency fee. If, for example, you are awarded $1M from a lawsuit that was handled for you by a contingency attorney who receives 30% of your lawsuit earnings, you may be under the assumption that you will only be required to pay taxes on the $700K you received. This is a false notion; you will be responsible for taxes on the entire $1M balance. If the settlement was for a personal injury case, you don’t have to worry, because compensation for personal injury cases are always tax-free as long as the entire balance is for personal physical injury or physical sickness recovery. If there were punitive damages or interest, those items will be taxable.

If you have hired a contingency attorney to help with an employment suit, you will only be taxed on the amount you receive after attorney fees have already been taken out. The majority of employment lawsuits result in recoveries which are viewed by the IRS as income. Therefore, they do not qualify for the same exclusion as physical injury or sickness. A settlement will either be in the form of wages which are subject to withholding at the time they are paid out or non-wage income which will be reported on Form 1099. In most cases, legal fees for personal matters are not tax deductible. Prior to 2018, there was an Internal Revenue Service (IRS) exception that allowed the deduction of legal fees associated with estate planning. However, those fees are no longer deductible. IRS Publication clearly states that “legal fees related to producing or collecting taxable income or getting tax advice are not deductible.” Since legal fees for preparing a will are not tax deductible, it is more important than ever to get as good of a rate as possible without compromising quality.

The following are a few tips to help you strike this balance when looking for estate planning services.

The number one way to find a good attorney at a good rate is to ask the right questions. Start by asking your friends, family, and trusted coworkers if they know any estate planning attorneys that they would recommend. Ask about their experience with that attorney. Check the attorneys’ websites and make a list of a few that you would like to get more information from and reach out to them. During your initial consultation with the attorneys you are considering, ask questions about the attorney’s knowledge, training, experience and prices. Some questions you may want to ask are:

• How many years have you been practicing law?

• Where did you graduate law school?

• About what percentage of your clients are estate planning clients?

• How does the estate planning process work?

• How will you keep me updated during the process?

• How quickly do you generally return calls or emails?

• What are your rates?

• Do you offer flat rate estate planning packages?

If you like a particular attorney but their price is out of your budget, explain your situation and ask for a discount. You may or may not receive one, but it is worth a try.

Historically, there were only two options for preparing a will and other estate planning documents: by using an attorney or doing it yourself. In the past few decades, a new middle ground option has emerged: legal service providers. Legal service providers prepare form documents based on your responses to questions. They are less expensive than using an attorney but produce better documents than doing it yourself. Legal service providers are not attorneys but most use attorneys to create and update their forms. Many also offer an add-on option where you can pay a little more to be able to talk to an attorney about your estate planning documents. This is typically still much less expensive than using an estate planning attorney. Legal service providers are typically best suited for routine estate planning for low or middle income families. If you have a nontraditional family, tax situation, or very high income, an estate planning attorney that can tackle the complex issues is usually a better choice. The bottom line is that while you cannot deduct legal fees from your tax returns, you can take steps to keep your estate planning legal costs low. Estate planning fees were tax-deductible, but are no longer. First, estate planning is the general term that covers arranging one’s assets and property for distribution at death to beneficiaries. It includes the creation of legal documents such as trusts and wills, as well as that of directives such as durable power of attorney and living wills. Estate planning isn’t only for the rich. Without a plan in place, settling affairs after one’s death could have a long-lasting and costly impact on loved ones. Unfortunately, recent tax changes have made it harder, if not impossible, to continue to deduct many estate-planning fees.

IRS Rules Changed

Some estate planning fees were eligible as an itemized deduction under IRS rules for miscellaneous deductions on Schedule A, but the Tax Cuts and Jobs Act changed that at least for now. Until recently, the IRS allowed that legal fees for estate tax planning services could have been tax-deductible if they were incurred for the production or collection of income; the maintenance, conservation, or management of income-producing property, or tax advice or planning. Many provisions of the Tax Cuts and Jobs Act will sunset at the end of 2025. A political change in Washington before then could also revive some deductions. Those who planned to deduct fees for advice on the construction of such income-generating instruments as an income trust or guidance on the use of property transfer methods, for instance, will generally now be unable to deduct the cost of the fees on their tax return. Other examples of per-fee services that are no longer deductible include investment advice for trusts held by the estate and trust tax preparation.1 Some fees were not deductible before the tax changes: estate planning relating to the simple transfer of property or guardianship as is common with most wills, for instance, or the use of estate planning instruments such as powers of attorney, living wills, or the writing of trusts to prevent estate assets from having to go to probate. Fees associated with tax planning advice (i.e., minimizing estate or income taxes), tax return preparations, and resolution of tax return audits could be a deduction under IRC Section 212. Thus, estate planning legal expenses or fees could be a tax deduction, but it would be only deductible to the extent it is allocable to tax planning. Furthermore, since many taxpayers do not itemize and since miscellaneous itemized deductions often do not exceed 2% of AGI, many taxpayers will receive no benefit from these deductions. Furthermore, IRC Section 68 phases out itemized deductions for taxpayers with higher incomes (joint returns with AGI above $309,900 and single filers with AGI over $258,250). Total itemized deductions are reduced by 3% by which the AGI exceeds these thresholds.

Common Fees

There are several fees that could be associated with your estate plan, but are those estate planning fees deductible? Most common are the charges paid to attorneys to draft, review and update estate related documents such as wills, trusts, powers of attorney, healthcare proxies, and other documents. These can be paid as the documents are drafted and other services provided or on a retainer basis for those who seek ongoing services.

Effects of Tax Reform

The tax legislation taking effect in 2018 has affected several aspects of estate planning, including if estate planning is tax deductible. Previously most taxpayers deducted their estate planning fees as an itemized deduction as a “miscellaneous expense.” These deductions (which also included tax preparation fees and unreimbursed employee expenses) have been eliminated in the tax reform for tax years 2018 to 2025. For the tax implication on estates and trusts, consult your own tax and estate planning professionals. Although this may disappoint some who were hoping to deduct these expenses on their personal income tax return, there are a few reasons why this may not have as great an effect on cost as it may seem. Even when estate planning fees were deductible, it was only for expenses related to the production of income, not for all estate planning fees in general. All miscellaneous expenses were also subject to a floor of 2% of Adjusted Gross Income or “AGI.” This means that to use the deduction, the total amount of miscellaneous expenses would have needed to be more than 2% of your total income after certain adjustments (retirement account contributions, for example) leading to AGI.

You would have also needed to have total itemized deductions that exceed the standard deduction, which is why the loss of this deduction may affect even fewer taxpayers than would have otherwise been the case. Although certain deductions have been reduced or eliminated by recent tax legislation, the standard deduction has also been increased. Since a taxpayer can only use the standard deduction or itemize, there are likely fewer people that would have been affected by the loss of this deduction. Although tax reform often has the goal of reducing taxes, simplification of the process is also a common goal. You may not have as many deductions, although your overall rates may lead to lower taxes paid in general. This is similar to what happened in the 1987 tax reform during the Reagan administration. Rates were lowered but certain deductions were eliminated. You could previously deduct not only your mortgage interest but income on consumer loans including credit card debt. That said, the benefits of estate planning could be enormous independent of tax-deductible fees.

Implications to Consider

Many types of estate planning strategies have tax implications. While the estate tax will also affect fewer people under tax reform, there are still monetary advantages to estate planning such as advanced charitable gifting strategies, many of which are tax-advantaged. Avoiding probate is also a significant cost benefit for many.

Speak with a Professional

This may be an appropriate time to state the importance of making sure that you are working with quality professionals and that they are coordinated with one another on related issues. If your insurance agent offers a policy that is tax-advantaged, make sure your tax professional is aware of the implications. Your estate planning attorney, for example, may need to know when new investment accounts are opened or existing accounts transferred to weigh in on how beneficiaries should be listed or if certain accounts should be held in a trust rather than by an individual. Many aspects of your financial life relate to one another. You may have specialists for tax issues, estate planning, insurance, retirement planning, investments and other areas. You may wish to consider working with a financial planner whose objective is, in part, to make sure these areas are coordinated well with one another, taking a big picture approach to your financial situation. Whenever tax season kicks off into gear, many of us look for ways to reduce our tax liability. Some, but not all, attorney fees are eligible for deduction. It depends on the type of legal service you sought. For instance, hiring an attorney for a child custody dispute or a personal injury case are both ineligible expenses. Legal expenses related to a business, such as collecting unpaid debt, are qualifiable.

Examples of Tax Deductible Legal Fees

• Business-related expenses such as seeking advice for a startup business

• Rental property expenses such as fees paid to evict a tenant

• Employment discrimination cases

Examples of Non-Deductible Legal Fees

• Personal injury cases including workers compensation

• Criminal cases

• Estate planning disputes

The Impact of Technology on Business Consulting

Technology has had a profound impact on the business consulting industry. In the past, business consultants relied on traditional methods such as face-to-face meetings, telephone calls, and paper-based reports to provide advice and guidance to their clients. However, with the advent of new technologies, business consultants are now able to provide more efficient and effective services.

One of the most significant impacts of technology on business consulting is the ability to provide remote services. With the help of cloud-based software, business consultants can now provide their services to clients from anywhere in the world. This has enabled consultants to expand their reach and provide services to a much larger client base. Additionally, cloud-based software allows consultants to collaborate with their clients in real-time, which can help to speed up the process of providing advice and guidance.

Another impact of technology on business consulting is the ability to access and analyze large amounts of data. With the help of data analytics tools, consultants can quickly and accurately analyze large datasets to identify trends and patterns that can be used to inform their advice and guidance. This can help consultants to provide more accurate and timely advice to their clients.

Finally, technology has also enabled business consultants to automate certain aspects of their work. Automation tools can help consultants to streamline their processes and reduce the amount of time they spend on mundane tasks. This can help consultants to focus more of their time and energy on providing high-quality advice and guidance to their clients.

Overall, technology has had a significant impact on the business consulting industry. By enabling consultants to provide remote services, access and analyze large amounts of data, and automate certain aspects of their work, technology has helped to make business consulting more efficient and effective.
